We are the exclusive importer of FABER and AIRFORCE appliances for the Czech Republic and the Slovak Republic. We manage sales on the Slovak market from the Czech Republic; we have no establishment in Slovakia.

We have not appointed a data protection officer. Please direct any questions to the e-mail address or registered office address given above.

2.What this policy covers

This policy describes how we process personal data obtained through the website digestory.sk (including its English language version) and in connection with it. It also applies to data you provide to us by phone, e-mail, post or in person – for example when you contact us with a question or a service request.

For the Czech website digestore.cz, the Czech language version of this policy applies. The controller is the same in both cases and the scope of processing is the same; only the language of the document, the supervisory authority and the rules on direct marketing differ. However, you give your consent to cookies separately for each domain, because it technically cannot be transferred between the digestore.cz and digestory.sk domains.

In case of any discrepancy between this English version and the Slovak version, the Slovak version prevails.

3.Why we process data, on what legal basis and for how long

  1. 3.1.

    Handling a question, an enquiry or a request to recommend a dealer.

    What data: first name and surname, e-mail, phone, content of the message, where applicable details of the appliance.

    Legal basis: Article 6(1)(b) GDPR (steps taken prior to entering into a contract) or Article 6(1)(f) GDPR – our legitimate interest in replying to your message.

    How long: 3 years from the last communication in the matter.

    Is providing the data mandatory? No, but without contact details we cannot reply to you.

  2. 3.2.

    Handling a warranty claim and a service request.

    What data: first name and surname, address where the appliance is installed, phone, e-mail, model and serial number, description of the defect, repair documentation, proof of purchase.

    Legal basis: Article 6(1)(b) GDPR (performance of an obligation arising from liability for defects or from a repair contract) and Article 6(1)(c) GDPR (compliance with legal obligations).

    How long: for the duration of the handling and a further 4 years after its completion. If a dispute is ongoing, until it is finally resolved.

  3. 3.3.

    Accounting and compliance with tax obligations.

    What data: billing and payment details, tax documents.

    Legal basis: Article 6(1)(c) GDPR – legal obligation.

    How long: We keep our accounts under Czech law: tax documents for 10 years from the end of the tax period in which the supply took place (Section 35 of Czech Act No. 235/2004 Coll., on Value Added Tax); other accounting records for 5 years from the end of the accounting period to which they relate (Section 31 of Czech Act No. 563/1991 Coll., on Accounting).

  4. 3.4.

    Sending commercial communications to business partners.

    We send commercial communications only to our business partners, i.e. dealers and customers with whom we have a business relationship, about new products in the range we supply to them. We do not send them to consumers or website visitors.

    What data: e-mail, first name and surname of the contact person, company name.

    Legal basis: Section 116 of Slovak Act No. 452/2021 Coll., on Electronic Communications, in conjunction with Article 6(1)(f) GDPR – our legitimate interest in direct marketing of our own similar goods to our own customers whose contact details we obtained in connection with the supply of goods, and, for partners that are legal entities, on the basis of the specific exemption for legal entities.

    How long: until an objection is raised or the recipient unsubscribes, but no longer than one year from the end of the business relationship; after that period we will contact the partner only with their prior demonstrable consent. We keep a record of the unsubscription for 3 years so that we can respect it.

    How to unsubscribe: via the link in every message or by writing to [email protected]. Unsubscribing is free of charge and we will apply it without further assessment.

  5. 3.5.

    Operation, security and traffic measurement of the website.

    What data: IP address, cookie and device identifiers, browser type, pages visited, time of access, source of the visit.

    Legal basis: for strictly necessary cookies and server logs, Article 6(1)(f) GDPR (legitimate interest in a functional and secure website); for performance cookies (Google Analytics 4), Article 6(1)(a) GDPR – your consent given in the cookie banner within the meaning of Section 109(8) of Slovak Act No. 452/2021 Coll.

    How long: server logs for 6 months, cookies for their validity period stated in the Cookie Policy .

    We do not use advertising or remarketing cookies on this website.

  6. 3.6.

    Protection of our legal claims and compliance with legal obligations.

    Legal basis: Article 6(1)(c) and (f) GDPR.

    How long: for the period laid down by law; for disputed claims, for the limitation period.

4.Where we get the data from

We obtain personal data directly from you. We may verify details of businesses in public registers (for example the Commercial Register or the VAT payer register).

5.Who we share the data with

We never sell your data. We share it only with the following categories of recipients, and only to the extent necessary:

  • Provider of website hosting, development and administration and of the e-mail distribution system – Webstein s.r.o., Bezručova 132/51, 591 02 Žďár nad Sázavou, Czech Republic, Company ID: 04885813

  • Provider of the traffic measurement tool (only with your consent in the cookie banner) – Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google Analytics 4, Google Tag Manager)

  • Contracted service partners – authorised service centres and service technicians whom we entrust with repairing your appliance; we share data with them only to the extent necessary to handle the specific service request (typically name, address where the appliance is installed, phone, model and serial number and description of the defect)

  • Carrier providing transport of the appliance to the service centre and back – TOPTRANS EU, a.s., Opravářská 944/2, 102 00 Praha 10 – Hostivař, Czech Republic, Company ID: 11966262

  • Appliance manufacturers – Faber S.p.A. and Airforce S.p.A., Italy, where necessary to assess or handle a warranty claim

  • Authorised representative for designated products – BEWATR s. r. o., 1. mája 525/71, 053 01 Harichovce, Slovakia, to the extent necessary to fulfil obligations under Slovak Act No. 79/2015 Coll., on Waste

  • Accounting, tax and legal advisers

  • Public authorities, where required by law

We have concluded a data processing agreement pursuant to Article 28 GDPR with all processors.

6.Transfers outside the European Union

If you consent to performance cookies, data obtained through Google Analytics 4 may be transferred to Google LLC in the United States of America. This transfer is based on the European Commission's adequacy decision under the EU–U.S. Data Privacy Framework, in which Google LLC participates, and additionally on standard contractual clauses approved by the European Commission. We will provide you with a copy of the safeguards on request.

Apart from this case, we do not transfer personal data to third countries.

7.Automated decision-making and profiling

We do not make decisions based solely on automated processing that would produce legal effects concerning you or similarly significantly affect you. We do not carry out profiling for advertising purposes.

8.Your rights

  • Right of access – you can ask us whether and what data about you we process and obtain a copy of it.

  • Right to rectification – we will correct inaccurate data and complete incomplete data.

  • Right to erasure – if the conditions of Article 17 GDPR are met, we will erase the data.

  • Right to restriction of processing – in the cases under Article 18 GDPR, we will only store the data and not otherwise use it.

  • Right to data portability – we will provide data you have given us and that we process on the basis of consent or a contract in a machine-readable format.

  • Right to withdraw consent – at any time, in whole or in part, without affecting the lawfulness of processing before its withdrawal. You can withdraw consent to cookies in the cookie settings, other consents by writing to our e-mail.

Right to object

You have the right to object at any time to processing we carry out on the basis of our legitimate interest (Article 6(1)(f) GDPR). If you object to processing for direct marketing purposes, we will stop processing your data for that purpose immediately and without further assessment. In other cases, we will assess whether our compelling legitimate grounds override your interests and rights.

You can raise an objection by writing to [email protected] or to our registered office address.

How to exercise your rights

Write to [email protected] or to our registered office address. We will reply within one month of receiving your request at the latest; in complex cases this period may be extended by a further two months, of which we will inform you. To protect your data, we may ask you to verify your identity.

Complaint to a supervisory authority

If you believe that we process your data in breach of the law, please contact us first. You also have the right to file a petition to initiate proceedings with:

9.Data security

We have adopted technical and organisational measures appropriate to the nature of the processing, in particular encrypted data transfer, access rights management, regular backups and training of the persons who work with the data.

10.Changes to this policy

We may update this policy, in particular when our activities change, further websites are launched or the law changes. The current version is always available at this address. We will inform you of material changes in an appropriate manner.
